Subway service from Munich to Garching secured


The complex financing agreement was concluded after lengthy negotiations between the city of Garching as the owner of the subway infrastructure, the district of Munich as the public transport authority and the Free State of Bavaria. It is linked to lease agreements between the city of Garching and the transport company of the state capital Munich, which form the basis for infrastructure usage fees to the city of Garching. Without the conclusion of the contracts, the district of Munich would not have been able to make an emergency award to MVG for two years and the subway trains of the U6 subway line would then only have been able to travel as far as the Munich city limits. 

OPPENLÄNDER Rechtsanwälte advised and represented the City of Garching as infrastructure owner with the assistance of Prof. Dr. Christofer Lenz, Dr. Corina Jürschik and Dr. Henrike Schulte. The district of Munich, the Free State of Bavaria and the transport company of the state capital Munich were also each advised by law firms with expertise in public transport. The parties involved want to ensure not only for two years, but also for the future through further agreements, that the legal framework of the European Regulation 1370/2007 on public passenger transport is complied with.
