In construction and planning law, we concentrate on representing developers in the public sector on major new development and extension projects. Shopping centres and large-area retail space including FOCs play an important part (department stores, specialist stores, supermarkets etc.). Development plans and zoning regulations must here be complied with so that the project can be implemented in consensus but if necessary even against objections of the local municipality or regional planning authority. In many cases we therefore employ the instrument of urban planning agreements between the investor and the municipality, for example in changing the use of previously commercial land to residential land, in the redevelopment of major inner city complexes or in the case of connections to public utilities. We advise municipalities on the preparation of zoning plans and the participants on questions of reclassification of land whether by exchange or by compulsory acquisition. We assist in construction permit proceedings in implementing projects against local political resistance, for example casinos.
We act in planning proceedings under the Energy Industry Act (high voltage cables, gas supply lines) as well as in water law and railway law and air transport law (airports). In these complex proceedings, we must usually reconcile competing public and private interests. We offer our clients the necessary long experience and special know-how necessary for the appropriate solutions, not only in official planning proceedings but also in subsequent litigation.
